Attorney Robert E. Pastor has been advocating for victims of sexual abuse for many years, and has brought lawsuits against religious organizations (including every Catholic Diocese in AZ), governmental entities (CPS / DCS / Probation Dept), schools, non-profits, medical professionals, and corporations for their failure to protect children and adults from sexual abuse. In fact, some of these lawsuits led to changes in policies and procedures that will protect children in the future.
While this area of work can be grueling at times, it is also rewarding when justice is achieved and a culprit is held responsible for their failure to do the right thing. For years, our team at Montoya, Lucero & Pastor, P.A. has watched attorney Pastor work tirelessly to help his clients find their voice and use it not just in the name of accountability, but also to protect children and to prevent abuse from occurring in the first place.
On May 28, 2019, Governor Ducey signed HB2466, giving survivors of child sexual abuse in Arizona additional time to pursue civil actions against their abusers. Victims of child sexual abuse may now sue their abusers and the institutions entrusted to protect children under ARS section 12-514. This new law means victims of child sexual abuse will now have a longer statute of limitations when it comes to filing civil lawsuits.
Under the new law, victims of child sexual abuse will have until their 30th birthday to sue their perpetrators and the institutions who were responsible for protecting children or who gave the abuser access to children. The new law also gives hope to victims of sexual abuse who were previously barred from bringing a claim. Victims of child sexual abuse who are over 30-years-old and who were previously barred by the two-year statute of limitations now have until December 31, 2020, to seek justice. So, time is of the essence.
